1. Scope These General Terms and Conditions apply to all bookings and services provided by SpreeAktiv GmbH in connection with boat tours, charter trips and tourist services under the ‘Berlin Boat Tours’ brand. 3. Conclusion of Contract Bookings can be made online via the Regiondo booking system, via partner platforms, by telephone or in person. Upon completion of the booking process, a binding contract is formed between the customer and SpreeAktiv GmbH. 4. Services The services offered are set out in the relevant service description on the website or the booking platforms. We reserve the right to make changes to the route, the vessel used or the timetable, provided these are necessary for technical, weather-related, regulatory or organisational reasons. 5. Departure Times and Boarding Trips take place daily in accordance with the current timetable. Passengers are requested to arrive at the jetty at least 10 minutes before departure. The vessel is usually ready at the pier 30 minutes before departure. There is no entitlement to be carried once the vessel has departed. 6. Prices and Payment The prices stated at the time of booking apply. Payment is made online, via partner platforms or on site using the payment methods offered. 7. Withdrawal, Cancellation and Termination The services offered are leisure activities with a fixed date or time period in accordance with Section 312g(2)(9) of the German Civil Code (BGB). There is therefore no statutory right of withdrawal. Irrespective of this, the following voluntary cancellation conditions apply: – Free cancellation up to 24 hours before the start of the trip – In the event of later cancellations or a no-show, there is no entitlement to a refund – Bookings may be rebooked subject to availability – Group bookings or special trips may be subject to separate terms and conditions Weather-related restrictions do not, as a rule, constitute grounds for withdrawal, provided that the trip can be carried out safely. 8. Cancellation of trips SpreeAktiv GmbH reserves the right to cancel trips for safety reasons, due to technical faults, force majeure, official orders or extreme weather conditions. In this case, one of the following will apply: – a rebooking, – a voucher, – or a refund of the ticket price. No further claims shall arise. 9. Conduct on board Passengers must follow the crew’s instructions at all times. It is prohibited to bring dangerous items, weapons or illegal substances on board. SpreeAktiv GmbH reserves the right to exclude intoxicated or disruptive individuals from the trip. 10. Liability SpreeAktiv GmbH’s liability is governed by statutory provisions. SpreeAktiv GmbH bears unlimited liability for damage resulting from injury to life, limb or health. For other types of damage, SpreeAktiv GmbH is liable only in cases of wilful misconduct or gross negligence, to the extent permitted by law. The limitation of liability does not apply in the event of a breach of fundamental contractual obligations. In such cases, however, liability is limited to foreseeable damage typical for this type of contract. No liability is accepted for lost or damaged personal belongings of passengers, unless there has been wilful misconduct or gross negligence. 11. Photographs and Video Recordings Photographs and video recordings may be taken for marketing purposes during events and trips. By boarding the vessel, the passenger hereby gives their general consent to this. Any objections may be raised with the crew before the trip begins. 12. Final provisions German law applies. The place of jurisdiction, insofar as permitted, is Berlin. Should any individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
